Camper Plus Membership Agreement UK

This Camper Plus Membership Agreement applies to Owners who choose to take out a Camper Plus Membership.
This agreement applies in addition to, and does not replace, the Camplify Terms of Service. It is a condition of your membership that you comply with the Terms of Service, Owner Rules and Community Rules. Any suspension or termination of your account under the Terms of Service will automatically suspend or terminate (as applicable) your membership under this agreement.
This Agreement and the Terms of Service contain the entire agreement between the parties in respect of the subject matter of this Agreement. The Terms of Service take precedence if there is a conflict between them the terms of this Agreement, except for the payment terms at Term, Listing Commission, and Cancellation paragraph h),
This Camper Plus Membership Agreement shall be construed in accordance with and shall be governed by the laws in force in England and Wales
Camplify Camper Plus Membership Benefits
As a Camper Plus member your membership automatically includes:
- Reduced listing commission
- For Flex owners - 25% discount on the daily rate for on-hire insurance provided by Camplify’s insurance partners;
- Priority payment terms
- Priority ranking in search
Term, Listing Commission and Cancellation
- Camper Plus Membership in respect of your RV is a 12-month contract (Initial Term).
- Your RV’s Camper Plus Membership subscription has a 14 -day cooling-off period in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To cancel your membership within the first 14 days see attached Instructions for Cancellation.
- If you have accepted any bookings during the period prior to your cancellation of your Camper Plus Membership, the benefits of Camper Plus Membership will not apply to those bookings and the standard Camplifty terms including listing commission, insurance charges and payment terms will apply.
- Your annual Camper Plus Membership subscription (Subscription Fee) is payable for each separate RV, for which you have taken out Camper Plus Membership.
- Subscription Fees can be paid annually or monthly. Camper Plus Members paying annually may receive a discount.
- If one or more of your membership subscription payment(s) is overdue Camplify may take action in accordance with the Terms of Service (including deducting outstanding Subscription Fees from hire fees, - service fees and other amounts payable to you, suspension of your account , suspension or termination of your membership).
- The total membership fees you have paid per financial year will be detailed in full on your EOFY Camplify tax statement.
- If you have a Camper Plus Membership, Camplify will charge you a reduced 6% commission (the Listing Commission) plus VAT on each booking, which will be collected by Camplify. The Listing Commission is charged on the booking’s RV hire fees, fees for hire of ancillary items, and fees for services such as delivery paid in respect of the booking. Camplify may vary the Listing Commission on 30 days’ notice in accordance with our Terms of Service.
- Subject to any deduction for unpaid Subscription Fees, Camplify will pay you the hire fees (less the Listing Commission) and service fee, received from the hirer in accordance with the following terms:
- 50% on the Thursday following the payment week (currently each Thursday to Wednesday ) in which the hire commenced. This is the initial payment; and
- 50% on the Thursday following the payment week in which the hire ends. This is the final payment.
- These percentages are based on the hire and other fees calculated when the booking was made. If there are any subsequent changes to the booking such as extension or reduction of days, or ancillary items added or removed, the split between the initial and final payment will be affected by the adjustments and not be 50/50.
- The Payment Week and pay day are subject to change in accordance with the Terms of Service.
- You may terminate the balance of your RV’s annual Camper Plus Membership by paying out the Term. To minimise disruption to hirers who have an upcoming booking for your RV, you are required to provide at least 4 weeks’ notice and follow the Camplify guidelines for deactivating your Camplify membership.
- You will not be required to pay out the Initial Term where you have sold your RV and have provided proof of sale. Remember that forward bookings are a contract between you and the hirer which you have an obligation to fulfill, you should plan a sale so that any booking commitments can be met.
- At the end of the Initial Term your Camper Plus membership will roll over to a month-to-month basis, unless you choose to pay annually in advance on renewal. After the end of the Initial Term, you may cancel your Camper Plus membership at any time of 4 weeks’ notice. If you paid your renewal annually in advance, the unused portion of your annual membership fee will be refunded.
- Camplify may vary the Camper Plus Subscription Fees from time to time on 30 days’ notice. If you are in the Initial Term of your membership or have paid your renewal annually in advance any increase will not apply until the end of your membership year. If your membership is on a month-to-month basis a fee increase will apply at the end of the 30 days’ notice.
- Nothing in this Campler Plus Membership Agreement is intended to limit your rights as a consumer under consumer laws including your entitlement to a refund or other applicable remedies.
Attachment - Instructions for Cancellation
Right to cancel
You have the right to cancel this contract within 14 days without giving any reason.
The cancellation period will expire after 14 days from the day your Camper Plus membership commenced.
To exercise the right to cancel, you must inform Camplify Co. (UK) Ltd of 20-22 Wenlock Road, Wenlock Road, London, England, N1 7GU, of your decision to cancel this contract by a clear statement via e-mail to owners@camplify.co.uk. You may use the model cancellation form below, but it is not obligatory.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you. We will make the reimbursement without undue delay, and not later than— 14 days after the day on which we are informed about your decision to cancel this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
